UAP Disclosure Act, House version · passed the House Jul 22, 2026

Amendment no. 315 to H.R. 8800, the FY2027 NDAA, sponsored by Rep. Eric Burlison with Crane, Carson, Luna, Moskowitz and Begich.

What it does: a UAP Records Collection at the National Archives, an independent, presidentially appointed and Senate-confirmed Review Board with subpoena power and accelerated special-access clearances for its staff, federal eminent domain over "recovered technologies of unknown origin and biological evidence of non-human intelligence", $20 million for FY2027, and a sunset of September 30, 2030.

Status: adopted by voice vote and passed with the House bill 216–212 on July 22, 2026, as Title XVII, Subtitle D, Secs. 1761–1772. The first time the full Act has passed a chamber. It now depends on conference with a Senate bill that has no UAP text.

UAP Disclosure Act, Senate version · pending since Jun 24, 2026

S.Amdt.6344 to S. 4784, the Senate FY2027 NDAA, submitted by Sen. Chuck Schumer with Sen. Mike Rounds.

Status: pending. Cloture on the motion to proceed to the Senate NDAA failed 50–46 on July 14, 2026 and the bill hasn't returned to the floor. The Senate Armed Services text, and both FY2027 Intelligence Authorization Acts, contain no UAP provisions.

Rep. Tim Burchett's bill to terminate AARO within 60 days, transfer its functions, and bar any similar centralised office at the Department of Defense or ODNI.

Comer–Garcia contractor whistleblower bill · introduced Sep 26, 2025

A bipartisan House Oversight bill extending whistleblower protections to federal contractors and grantees, including those who disclose violations of law or refuse unlawful orders. Relevant because many UAP witnesses work in contractor roles.

Gillibrand–Cotton UAP shoot-down authority · announced Aug 6, 2025

Sen. Kirsten Gillibrand said she was developing legislation with Sen. Tom Cotton to authorise the Pentagon to shoot down UAP over military installations and other high-security sites.

Three defence bills carry UAP provisions. None of them is the Disclosure Act.

FY2026 NDAA (Pub. L. 119-60) · signed Dec 18, 2025

Three UAP sections survived conference.

  • Sec. 1671: AARO's congressional briefings must detail every UAP intercept by NORAD or NORTHCOM, with the first briefing reaching back to January 1, 2004.
  • Sec. 1672: the DNI and Secretary of Defense must make UAP data available to AARO "immediately".
  • Sec. 1673: AARO must account within 180 days for the classification guides applied to UAP.

The UAP Disclosure Act was not included, and nobody on the record has said who removed it.

What survived of the 2023 UAP Disclosure Act after conference: a UAP Records Collection at the National Archives and a requirement that agencies identify and transmit UAP records to it. The Review Board, eminent domain and subpoena provisions were stripped.

Sec. 1673 (50 U.S.C. 3373b): current and former personnel may disclose UAP information to AARO "notwithstanding any nondisclosure agreement". The 2026 NDA waivers largely restate this for the PURSUE channel.

  • AARO's first Sec. 1671 intercept briefing (covering 2004 onward) and the Sec. 1673 classification-guide accounting, due in the 2026 annual report.
  • Whether the Secrets Task Force continues after the election, which Rep. Robert Garcia says Democrats will decide in November.
